Terms, Conditions & Process

1. Order Process: Upon placing your order, you will receive an email requesting 2-3 inspiration images that capture your desired vibe and signage aesthetics. Nestle & Porter will also send you through your appropriate copy templates. We will then present you with two design options, allowing for up to two rounds of revisions, excluding complete redesigns.

2. Proof and Printing: You will receive your initial proof one month before the required date to ensure ample time for review and approval. Printing requires a minimum of 7 business days for completion. All signage must be collected from our Leederville office during our business hours (8am-6pm); unfortunately, delivery services are not available.

3. Proof Review: It is crucial that you thoroughly review and approve all proofs and design concepts provided by Nestle & Porter. Once approved, Nestle & Porter cannot be held liable for any errors or omissions identified thereafter.

4. Payment and Refunds: Full payment is required before the commencement of any design work. Please note that payments are non-refundable once the order has been confirmed.

5. Materials and Ownership: All signage will be printed on 3mm forex. All initial design concepts, drafts, proofs, and final deliverables remain the exclusive intellectual property of Nestle & Porter. Nestle & Porter reserves the right to showcase and feature photos of the finished signage on our social media platforms, unless otherwise specified in writing by the client. This will only be after the event has taken place.

6. License and Usage: Upon receipt of full payment, you will be granted a non-exclusive, non-transferable license to use the approved design solely for its intended purpose, unless otherwise agreed upon in writing. 

7. Client Responsibilities: Clients are prohibited from reproducing, modifying, or distributing designs without prior written consent from Nestle & Porter. The accuracy of all provided content, including text, images, and other materials, is the sole responsibility of the client.

8. Third-Party Use: Any third-party use, reproduction, or modification of the designs requires explicit written consent from Nestle & Porter.

9. Colour Accuracy: Please be aware that colours may vary between digital representations and printed materials. While we strive to achieve accuracy, it is recommended that clients request physical colour proofs or samples for projects where colour fidelity is critical.

10. Legal Compliance: Clients are responsible for ensuring that the final design complies with all applicable laws, including those pertaining to copyrights and trademarks.

11. Fees and Charges: Clients agree to pay all fees and charges specified in the project proposal or invoice promptly upon receipt.

12. Confidentiality: Both Nestle & Porter and the client agree to maintain strict confidentiality regarding any proprietary or sensitive information exchanged during the course of the project.

13. Governing Law: This agreement shall be governed by and construed in accordance with the laws of Western Australia.

14. Entire Agreement: These terms and conditions constitute the entire agreement between Nestle & Porter and the client, superseding any prior agreements or understandings, whether written or oral.
